I. The Benefits of Timely Recognizing a Potential Interference

Timely recognizing a potential interference allows your client to act before certain legal and business options are foreclosed. Failing to request an interference within one year of the issuance of the target patent bars your client (1) from obtaining an interference and (2) from obtaining patent claims defining substantially the same subject matter as claimed in the patent.1 Failing to request an interference within one year of the publication of an application will under certain circumstances also bar your client from obtaining both an interference and the claims in the published application.2

Applications targeting a patent for an interference that are filed after the issuance of the target patent must make certain showings in the interference by the burden of clear and convincing evidence as opposed to the otherwise generally applicable burden of the preponderance of the evidence.3 Promptly requesting an interference with a target application may result in an interference with the target application as opposed to an interference with a patent issued from the target patent. Dragging the target application into an interference before it can issue into a patent can be advantageous because, normally, no patent will issue from the target application until judicial review of the interference is terminated.5 The duration of the interference and all judicial review can be substantial. Therefore, failing to timely request an interference could result in your client unnecessarily facing a patent instead of an application for the duration of the interference and judicial review of the interference. Furthermore, if your client requests a stay in litigation in which it has been accused of infringement of a patent based upon the existence of an interference involving the patent, it is more likely that the stay will be granted if an interference is procedurally advanced relative to the litigation than vice versa.6 Finally, late recognition of problem patents increases the costs of designing, licensing, or abandoning the market.

For all of the foregoing reasons, early recognition of the potential for an interference can be advantageous. Conversely, preventing a competitor from timely identifying your client's patent applications increases the value of your client's patent portfolio. I focus in this paper on practices you can employ to identify relevant patent information, such as potential interferences, to prevent competitors from identifying your client's patent information, and to explain what you can or should do when you identify a potential interference.

II. Obtain and Use Competitive Intelligence

Your client will never know a patent problem exists (until it is too late) unless it is obtaining competitive intelligence. Each company should employ a procedure to obtain competitive intelligence. Most companies set up an information "watch," which is a periodic retrieval of targeted information, as part of this procedure.

There are numerous commercial databases containing relevant patent and non-patent information. Table 1 (see section VIII) lists some of the more popular commercial database sources, and it lists pros and cons of each vendor's services.7 As Table 1 shows, no one vendor supplies all potentially useful sources of competitive intelligence. Therefore, a good policy is to use a plurality of database vendors to gather relevant information for analysis.

If a company does not have an in-house information specialist, it may be cost effective and more reliable for it to contract with a consulting information specialist instead of attempting to internally implement a watch. This is because a suitable “watch” may involve retrieving data from multiple data vendors, and the watch may need to be tweaked from time to time to provide desired information. Moreover, it may be desirable to conduct non-automated database searches for certain information. Information specialist organizations include the Association of Independent Information Professionals (AIIP), the Society for Competitive Intelligence (SCIP), the Special Libraries Association (SLA), and the Patent Information User's Group (PIUG).8

One source of patent competitive intelligence is disclosures by or to your client, typically in connection with offers to sell IP, settlement or merger negotiations, or duties pursuant to a joint venture. Consider including in the underlying agreement terms defining the rights to pursue inter partes administrative actions, such as interferences. Likewise, be aware of the possibility of requesting administrative action, such as interferences, if your agreement permits (or does not expressly exclude) them.

III. Patent Procedures Relating to Competitive Intelligence

In this section, I list procedures to employ for (1) limiting or delaying access to your client's patent or confidential information and (2) obtaining access to information about patent applications of others.

A. Limit Access to Your Client's Applications

If there is information that you feel obliged to submit in a 35 USC 111(a) patent application, a reissue patent application, or a reexamination, and you want that information to remain confidential, consider filing the information pursuant to MPEP section 724 concurrently with a rule 37 CFR 1.59 petition to have the information expunged if the information is found to be not important to patentability. If you file such a petition, the confidential information will not be made available to the public and will be returned to the applicant if an examiner determines that the information is not "important to a reasonable examiner in deciding whether to allow the application to issue as a patent."9

Second, anyone can access the file of an abandoned unpublished United States patent application if the application is referred to anywhere in the file history (not just when it is referred to in the specification) of an issued patent.10 Why is this important? Partially because of the duty to disclose "Information Relating to or From Copending United States Patent Applications,"11 such as information "[f]or "different applications pending in which similar subject matter but [arguably] patentably indistinct claims are present."12 Accordingly, it is a common practice to file IDSs containing copending application statements. These statements may include the specification, figures, claims, or merely the serial numbers of the related applications. Keep in mind that the claims are potentially material vis-a-vis a double patenting determination. In any case, that practice can eventually enable an adverse party to access the file histories of the cited applications - - even if those applications are subsequently abandoned. In addition, for reexaminations and reissue applications, that practice provides your client's competitors potentially damaging information. Therefore, you may want to file a 37 CFR 1.59 petition along with each copending application statement.

B Obtain Information Regarding Competitor's Patent Applications

If you are interested in whether there are any pending applications related to either a published United States application or an issued United States patent, simply look on the continuity link for parent and child data in PAIR, or telephone or fax your request for that information to the USPTO.13 Continuity and status information is extremely useful in targeting patent applications for an interference or a public protest.

In certain instances, an application priority to which is claimed in a PCT publication is not readily available from the USPTO. In those instances, be aware that copies of the priority applications may be obtained directly, promptly, and inexpensively from the International Bureau in Zurich.

You can request status information from the USPTO to determine whether a 371 application has been filed based upon a published PCT application by sending a request for status information to the PCT Legal Office either by mail or by facsimile to 703-308-6459, including a cover of the published PCT application, and a letter requesting status. The PCT Legal office will then mail you a letter providing status, including the US serial number, if one exists.14

Finally, you can now order from the USPTO a copy of any paper cited in the PAIR file for a published application.15

IV. The Law Relevant to Requesting an Interference

Deciding what action, if any, to take when you identify a potential interference requires knowing the relevant law. The relevant law includes inter alia 35 USC 102(g), 35 USC 135(a), 35 USC 135(b), 37 CFR 1.604, 37 CFR 1.607, 1.608, and 1.617, 1.658(c) and related interference estoppel, and 37 CFR 1.657. 35 USC 102(g) defines the circumstances in which secret inventions are prior art. 135(a) defines what constitutes interfering subject matter. 135(b) defines a patentability and interference bar. Rules 604 and 607 define the requirements for an applicant to copy claims and request an interference. Rule 608 defines the showing an applicant must make prior to the interference to convince the examiner to recommend the interference.16 Rule 617 defines the degree of proof required in an applicant's 608(b) showings necessary to avoid losing the interference when it is declared. 37 CFR 1.657 defines who has the burden of proof on priority.

I briefly review this law below and provide practice advice interspersed with the review. However, note that you are obliged to notify the examiner when you present claims substantially similar or copied from a target patent or application that you are doing so, and failure to do so is a sanctionable act of misconduct.17 Merely citing the target application or patent in an IDS is not sufficient to satisfy this obligation.

A. 35 USC 102(g)(1) - Procedural Limitations on Secret Prior Art

35 USC 102(g)(1) defines inventive activity that occurred abroad to be prior art only in an interference.18 In contrast, 35 USC 102(g)(2) defines inventive activity that occurred in the United States to be prior art without limit to the type of action.19 As a consequence, a company's inventive activity that occurred abroad will not provide a 102(g) prior art invalidity defense to a charge of infringement of a patent. It follows that foreign company's have a greater incentive than domestic companies to request interferences, since that action is more likely to be the foreign company's only recourse to avoid liability for patent infringement.

B. 35 USC 135(a) - Criteria for an Interference

35 USC 135(a) states that an "application ... which, in the opinion of the Director, would interfere with any pending application, or with any unexpired patent..." may be the basis of an interference. In other words, the statutory language leaves the criteria for what constitutes interference at the complete discretion of the Director. The Director's discretion is circumscribed by 37 CFR 1.601(j) and (n), which define an "interference-in-fact" based upon a "same patentable invention" test. A literal reading of those rules would indicate that the test for interfering subject matter is the same as the usual test for obviousness-type double patenting; a one-way obviousness test. However, in Winter v. Fujita,20 an expanded panel of the Board held that interference-in-fact required a "two-way patentability analysis," stating that:

Resolution of an interference-in-fact issue involves a two-way patentability analysis. The claimed invention of Party A is presumed to be prior art vis-a-vis Part B and vice versa. The claimed invention of Party A must anticipate or render obvious the claimed invention of Part B and the claimed invention of Party B must anticipate or render obvious the claimed invention of Party A. When the two-way analysis is applied, then regardless of who ultimately prevails on the issue of priority, the Patent and Trademark Office (PTO) assures itself that it will not issue two patents to the same patentable invention.

Winter still leaves some wiggle room as to when there exists interfering subject matter since a "two-way patentability analysis" does not specify that there must be two-ways obviousness between the claimed inventions. However, my current understanding from the case law and the guidance provided by members of the Trial Section21 of the Board at various bar meetings is that an interference would require two-ways obviousness between the parties' claims, except in unusual circumstances. However, one important point to note is that a claim in an application to a species of a genus may be insufficient to provoke an interference with a claim in a target application or patent to the genus.22

C. 35 USC 135(b) - The Statutory Bar

35 US 135(b)23 provides a "triple whammy."

First, it precludes untimely attempts to provoke an interference.

Second, it precludes getting a patent on claims defining substantially the same subject matter as claims in an issued patent or published US application that are not timely presented.

Third, since the 135(b) "substantially the same subject matter" criteria may be narrow than the135(a) "same patentable invention" criteria, anomalous situations may occur where 35 USC 135(b) may bar an interference even when claims that were timely presented met the 35 USC 135(a) criteria. As a result, the applicant requesting the interference (1) may be barred from the interference and (2) barred from getting a patent even when there is no 135(b) bar. This is because 37 CFR 1.131 does not allow antedating a patent or published application for claims that define the "same patentable invention"24 as the claims in the patent or published application.

35 USC 135(b)(2) presents special problems since it bars late presented claims to "an application published under section 122(b) of this title," and 35 USC 374 accords to published PCT applications the same force and effect as published US application, except for 102(e) and 154(d).25 The special problem arises in that not all PCT applications are published in English, but all PCT publications may serve as the basis for a 135(b)(2) bar. Accordingly, it may be difficult to identify a claim in a foreign language (e.g., Japanese, German, or French) published PCT application defining subject matter that would be a problem for your client, and just as difficult to determine whether your client's applications have support to copy those claims. However, if you can identify potentially relevant PCT published applications, you can address this problem by obtaining an automated English translation of at least the claims using free web services, such as those linked on my firm's web site at: http://www.neifeld.com/autotrans.html

The terms of 135(b)(2) limit the bar based upon published applications (including PCT application) to claims presented in applications filed after the publication date of the published application. Thus, there is no time bar on copying claims in an application that was pending when the potentially interfering application was published. 35 USC 374 would imply that no 135(b)(2) bar would exist to claims filed in your client's own PCT application when your client's own PCT application was filed prior to the publication date of the target application. However, in my opinion, the USPTO has not clearly defined whether it considers claims in a PCT application in the international stage to be "pending." Accordingly, your client should not rely upon "pending" claims in its own PCT application to satisfy 135(b)(2), unless that application has been nationalized in accordance with 35 USC 371.

D. 37 CFR 1.604, 1.607, 1.608, and 1.617, and Requesting an Interference

Rules 604 and 607 specify what you need to show to get into an interference.

37 CFR 1.604(a) specifies the requirements for requesting an interference with a pending application, which are: (1) suggesting a proposed count, (2) presenting at least one claim corresponding to the proposed count or identifying at least one claim in its application that corresponds to the proposed count, (3) identifying the other application and, if known, a claim in the other application which corresponds to the proposed count, and (4) explaining why an interference should be declared. 37 CFR 1.606 is useful in understanding item (4). Rule 606 states that before "an interference is declared between an application and an unexpired patent, an examiner must determine that there is interfering subject matter claimed in the application and the patent which is patentable to the applicant subject to a judgment in the interference." Thus, the explanation why an interference should be declared should at least allege that the claims in the application are patentable to the applicant, but for the potential interference.

37 CFR 1.607(a) specifies the requirements for requesting an interference with an issued patent. These requirements are the following: (1) identifying the patent, (2) presenting a proposed count, (3) identifying at least one claim in the patent corresponding to the proposed count, (4) presenting at least one claim corresponding to the proposed count or identifying at least one claim already pending in its application that corresponds to the proposed count, (5) if any claim of the patent or application identified as corresponding to the proposed count does not correspond exactly to the proposed count, explaining why each such claim corresponds to the proposed count, (6) applying the terms of any application claim identified as corresponding to the count, and not previously in the application to the disclosure of the application, and (7) explaining how the requirements of 35 U.S.C. 135(b) are met if the claim presented or identified in your client's application as interfering were not present in the application until more than one year after the issue date of the patent.

37 CFR 1.608(a) applies when the effective filing date of an applicant requesting an interference with a patent is later than the effective filing date of the target patent by no more than three months. Rule 608(a) requires the requestor to file a statement alleging that there is a basis upon which the applicant is entitled to a judgment relative to the patentee. Since the allegation is usually based upon priority, you must conduct a priority investigation to make this statement.

37 CFR 1.608(b) applies when the effective filing date of an application in which an applicant requesting an interference with a patent is later than the effective filing date of the target patent by more than three months. Rule 608(b) requires the applicant requesting the interference to submit evidence and explanations demonstrating that applicant's application is prima facie entitled to a judgment relative to the patent. However, rule 608(b) states that "the examiner will consider the evidence and explanation only to the extent of determining whether a basis upon which the application would be entitled to a judgment relative to the patentee is alleged and, if a basis is alleged, an interference may be declared," whereas 37 CFR 1.617(a) states that the APJ will review the evidence filed in connection with rule 608(b), and, if the APJ determines that the "evidence fails to show that the applicant is prima facie entitled to a judgment relative to the patentee, the administrative patent judge shall, concurrently with the notice declaring the interference, enter an order stating the reasons for the opinion and directing the applicant, within a time set in the order, to show cause why summary judgment should not be entered against the applicant." 37 CFR 1.617(b) also states that "additional evidence shall not be presented by the applicant or considered by the Board" in response the show cause order. In other words, if the applicant's interference request alleges but does not make a prima facie case for a date of invention prior to the effective filing date of the target patent, the applicant will not be able to supplement that evidence and will be faced with a show cause order, most likely resulting in swift judgement against the applicant.26 Accordingly, whenever a 608(b) showing is required, it is essential that the showing be sufficient so that the applicant is prima facie entitled to judgement relative to the patentee.

E. 37 CFR 1.658(c) Estoppel, Interference Estoppel, and Issue Preclusion

1. In the USPTO

37 CFR 1.658(c) defines the estoppel effect in the USPTO with respect to all issues that were or could have been raised in the interference.27 This includes estoppel with respect to claims defining patentably indistinguishable inventions from a count,28 and to claims to subject matter commonly disclosed (whether or not claimed) in any applications involved in the interference.29

2. In Subsequent Litigation

Issues decided in an interference proceeding may be accorded issue preclusion effect in subsequent litigation. The burden of proof on most issues in an interference proceeding is preponderance of the evidence.30 The corresponding burden in infringement litigation is clear and convincing evidence. In all cases, the burden of proof in the interference proceeding is no higher than the burden of proof in infringement litigation. Therefore, the decisions on issues actually litigated in the interference proceeding should be granted issue preclusion effect in subsequent infringement litigation.31

F. 37 CFR 1.657 - Burden of Proof on Priority

37 CFR 1.657 defines the burden of proof as to date of invention to be on the party with the later effective filing date, and that the burden increases from preponderance of the evidence to clear and convincing evidence if the effective filing date of the application is after the effective filing date of the target patent, and that burden does not shift based upon submission of priority evidence.32

V. File Early

If your competitive intelligence is lucky enough to identify that your client's competitor is about to file a patent application on contested technology, or obtain a patent on that technology, your client should file immediately. As just shown, the burden of proof on priority depends solely upon effective filing and issue dates, and pointedly does not depend upon evidence of inventive activity.

VI. Respond to Published United States or PCT Applications

Assume your client identifies a published United States or PCT application (1) which designates the United States and (2) the claims of which cover or relate to your client's technology. Your client should first consider preserving its rights in view of 35 USC 135(b)(2).

135(b)(2) will bar your client from presenting claims to substantially the same subject matter as claimed in a published application when your client files such claims (1) more than one year after publication and (2) in any application filed after the date of the publication. Therefore, your client should consider either copying claims from the published application in a previously filed 35 USC 111(a) or 35 USC 371 application or filing a new application and copying the claims in the newly filed application. Your client should copy exactly the same claims as in the published application (to the extent possible based upon support in your client's application's specification) to ensure compliance with 135(b). In addition, your client can present additional claims modeled after the published claims which exclude limitations for which your client arguably does not have support in their specification, exclude limitations for which your client arguably does not have an early priority date, and correct indefiniteness problems. This approach provides the best possible chance for your client meeting the 135(b) bar and also obtaining allowable claims that are also interfering with the target claims.

Keep in mind that you are obliged to notify the Office of the target application and the fact that you are copying claims from it, even if the target application is a PCT application in the international stage. This is because 37 CFR 1.604(b) states that you must notify the Office when you present a claim that you know "define[s] the same patentable invention claimed in a pending application for all purposes except 102(e) and 154(b), pursuant to 35 USC 374. Therefore, the requirement to notify the Office when copying claims from an application specified in 37 CFR 1.604(b) applies to copying of claims in a PCT application in the international stage.

Moreover, if your client files a new application for use as a vehicle for interference with a national stage or continuation of the published PCT application, consider filing a non-publication request, and an IDS identifying your client's applications disclosing or claiming similar subject matter, and a 37 CFR 1.59 petition to expunge the IDS information. Similarly, your client should consider filing IDSs in the cited applications identifying the new application along with petitions to expunge in those applications.

Note that your client's opponent in the interference will have access to the file history of your client's involved application and all applications to which it claims priority. Therefore, even a non-publication request in your client's involved application will not immunize information regarding your client's similar applications identified in an IDS from eventual discovery.

It is extremely unlikely that the USPTO would declare an interference involving claims in a PCT application.34 Therefore, even though your client may promptly copy claims into their application, it makes little sense to present a complete 37 CFR 1.604 request at that time. You should file the 604 request in your client's application when there is a 35 USC 371 national stage (or 35 USC 111(a) continuation) of the target PCT application, since you can then identify in your client's interference request the United States serial number of the target application. A 371 application will be published several months after it is on file in the USPTO. However, as a third party, you can periodically request status information from the USPTO based upon the publication of a PCT application to determine whether a corresponding 371 application has been filed in order to identify the serial number of the 371 application prior to its publication. That will allow you to more promptly request an interference.

You should promptly file an interference request targeting the published United States 35 USC 111(a) or 371 application because it takes most interference requests roughly two years to mature into interferences.35 Prompt filing increases the chances that an interference request will be considered and an interference declared prior to issuance of the target application into a patent. Moreover, you should periodically check for papers filed in the target application using PAIR, obtain copies of paper filed in it, copy into your application any additional or amended claims presented in the 371 application to which your client believes it has a right, and update your 604 request accordingly.

When you file an interference request targeting a competitor's application or patent, consider filing a paper in the style of a public protest in each of the applications related to the target application or patent pointing out that the subject application is related to the target application or patent, and should be examined in view of that fact relationship.36 That may bring the existence of the interference request to the attention of the examiners of the related applications, and enable those examiner to consider the impact of the interference request on the subject application. This action may result in the related applications being included in the interference, having prosecution in them stayed until the interference is terminated, or at least receiving a heightened level of examination.37 However, you are also obliged to serve a copy of any public protest on the attorney for the target application, 38 thereby notifying the adverse party of your interference request. You will have to weigh benefits and drawbacks of this procedure in each situation.

VII. Consider Splitting Subject Matter Between Applications in View of Temporal Delays and Interference Estoppel

Your client needs to take into consideration the potential time line, outcome, consequences of the outcome, and cost when deciding what action to take in view of a potential interference. Based upon these considerations, your client can make a reasoned decision (1) whether to attempt to provoke an interference and (2) whether to also attempt to promptly obtain issued patents on closely related but arguably non-interfering subject matter. The important point is to identify these issues prior to taking action and to weigh the benefits and drawbacks before deciding to act.

Keep in mind that the motivation for filing most interference requests is that the existence of another's exclusive right to the target claims is unacceptable from a business perspective. Therefore, the most important goal of most of the parties requesting interferences is to obtain cancellation of the other party's claims.

A. Probable Time Line for an Interference

Most probably, an interference request will result in an interference in roughly two years after the date the request for the interference is filed. Most probably, the interference proceeding in the USPTO will take about two years. Most probably, any 35 USC 146 action following the interference will take about two years. Most probably, any 35 USC 141 appeal will take about a year. Therefore, any hard fought interference and its judicial review may take on the order of five years. Most probably, post interference prosecution and issuance of a prevailing applicant's application will take about a year.

B. Predicting the Outcome and Consequences of the Outcome

Predicting the outcome of an interference depends upon the known facts of the case (e.g., your priority evidence and known prior art) and guesses as to unknown facts (e.g., your opponent's priority evidence and unknown prior art). Thus, any such prediction and the confidence level of the prediction depend upon the facts of the case.

1. Consequences of Losing the Interference

If your client "loses"39 the interference, it may end up with no patent, and 37 CFR 1.658(c) may bar it from any claims to any subject matter disclosed or obvious in view of the disclosure of the other applications (or patents) involved in the interference. In contrast, if your client does not provoke an interference, it may obtain claims dominating or subservient to the claims of the target application or patent, and these may be claims that your client would be precluded from obtaining if it pursued an interference. Theoretically, that should not happen since, theoretically, your client and the owner of the target application or patent should be entitled to the same claims in any case. However, interferences adduce additional evidence than exists in ex parte prosecution, decisions of the APJs on patentability and the scope of interfering subject matter may differ from those of ex parte examiners, and failure to either raise certain issues or carry the burden of proof on certain issues in an interference may all result in different outcomes in interferences than in corresponding ex parte prosecution.

2. Consequences of Prevailing in the Interference

If your client prevails in the interference, (1) corresponding claims in the opponent's application or patent will be canceled, and your client's application will be entitled to an amount of term extension40 unless term is limited by a terminal disclaimer. In addition, issue preclusion may apply in a follow on infringement litigation by your client on its patent issuing from its application involved in the interference against the other party in the interference.

If your client has previously obtained patents with claims to closely related subject matter, you may be forced to file in your client's interference application a terminal disclaimer to moot a double patenting rejection, thereby losing any potential term extension that may be afforded by the AIPA due to the duration of the interference and subsequent judicial review. This is a factor to weigh when considering prosecution of related applications. In this regard, also keep in mind your rule 56 duty to provide information from the interference to the examiner examining any relevant application, whether you win or lose the interference.41

C. Costs of an Interference

Most interferences cost several hundred thousand dollars to litigate; roughly ten percent of the cost of a patent infringement litigation. Interferences are procedurally complex, usually requiring the interplay of priority and patentability issues respecting both parties' claims. However, interferences allow much more limited discovery than district court infringement litigation, they do not deal with issues of infringement or damages, and therefore they cost less than infringement litigation.

VIII. Count Formulation for an Interference Request

The vast majority of interference proceedings terminate prior to a decision on priority. However, priority is the ultimate issue, and the reasons why interferences terminate are logically related and dependent upon priority. For example, a decision on motions that a party lacks support for its involved claims will result in termination of the interference via a judgement against that party. However, lack of support implies that the party does not have priority for the subject matter defined by the count. Likewise, parties settle or concede based upon factors including the likelihood of prevailing on priority. Therefore, priority is an issue you should be concerned with when requesting an interference.

Priority in an interference is awarded on a count by count basis. The party losing priority with respect to a count will not be entitled to claims corresponding to that count, which are all claims that define the same patentable invention as the count. Claims corresponding to the count are supposed to define obvious variations of the subject matter defined by the count. The count is supposed to define subject matter that is non-obvious over the of the prior art. The count is an artificial legal construct defined by the APJ at the beginning of the interference in the declaration of the interference. However, interference requests must include a propose count or counts. Often, the proposed counts are the same as the counts defined in the declaration of the interference.

Moreover, a party requesting (via motion) in the interference proceeding that the count be change has the burden of the preponderance of the evidence to explain why the count should be changed. The majority of motions in interferences are denied. Therefore, it is statistically unlikely that the count will be changed via a motion in an interference. Therefore, your client has the possibility of influencing the outcome of the interference by what count or counts it proposes in its request for an interference, and what claims it presents prior to the interference.

The logical procedure to follow to propose a count is to determine your client's relevant priority information, obtain what priority information you can regarding the target application, such as the disclosure of any applications to which the target application claims priority, relevant press releases on the target company's products, publications of the named inventors, and information on the employment histories of the named inventors, and propose a count (1) that you believe to be non-obvious over the prior art and (2) that provides the highest probability that your client will have priority over the other party's priority for the subject matter defined by that count.

In addition, you should present in the interference request claims identical (or as close as possible given the limitation of support in your client's application) to the proposed count. This is at least because the existence of such claims may preclude an argument by your opponent in the interference why the count should be changed.

can my emplyer not schedule me to work if I am on workmans comp and can only do lite duty rather than regular?

I was injured at work (RN) in june and my doctor put me on light duty - paperwork only- rather than the usual patient care that I do as nurse. After 8 weeks on light duty my unit manager simply didn't schedule me at all for the current 4 weeks. I am not earning money, I am not doing "light duty" or anything! The irony is that I was returned to my full duties the last two weeks of the current work schedule - but the new schedule was alrady out with me being "x-ed" out the entire 4 weeks. She used up all my PTO timeso I would get paid for part of the first two weeks of this new schedule which has me not working at all. I was scedhuled for vacation in October to take a class and now have no PTO to cover it. I thought she had to schedule me according to my contract of 36 hours/week whether I was doing "light duty" or regular duty. What are my rights in this matter? Is she not suppose to schedule me to work so I can earn income? Can I demand payment rather than use up my PTO?

If your work comp doctor gave you temporary restrictions, and your employer cannot give you work, then you're entitled to temporary disability. Once doctor puts you on full duty, you're entitled to temporary disability until your employer is able to have you return. Just because the next work schedule doesn't start for another week doesn't mean you are no longer entitled to temp disability.

In your scenario, you should not have used up your PTO. You'll need to bring this up with both your adjuster and your H.R.

Moving Guide: Moving with Pets

Americans and their loved pets move on average every seven years. If you have a pet or pets, remember that they also experience stress, particularly from moving. In many cases, moving can be even more stressful on pets, as the home is their habitat. Pets can also become very frightened when faced with unfamiliar situations. Careful organization and planning can make the moving process easier and less stressful for both you and your pet. Our guide offers tips and advice to help you and your pet through this process.

Pet travel warning

• Never move a sick pet – the move may aggravate his symptoms and be dangerous to his health.

• The Animal Welfare Act makes it illegal to transport puppies and kittens less than eight weeks old by air.

• Pets cannot be moved on a moving van with your household belongings.

• Pets are generally not allowed on trains or buses, unless they’re guide-dogs accompanying blind or otherwise impaired persons.

• Book a direct flight if you are traveling by plane. If your pet is traveling in freight he may be sitting outside with the freight for a long period of time between flights and as the freight is being moved from plane to plane. If the weather is either too hot or too cold your pet will suffer. An insulated crate will certainly help this situation if it cannot be avoided.

Air Transport

You may transport your pet by air either accompanying you or as air freight. Some airlines provide counter-to-counter service so your pet will be carried on and off the plane by an airline employee. Remember, not all airlines accept pets for transportation, so be sure to inquire when you are making your travel arrangements. Also be sure to check about charges and insurance charges for transporting your pet.

It is important that you book your air travel as early as possible. Airlines that accept pets for transportation will have specific regulations and guidelines regardless of whether the pets are accompanied or unaccompanied. For example, you may be required to be at the airport several hours in advance of the flight to check your pet in and your pet may need a special crate. The airline may be able to provide to you a crate for the trip, or you may have to purchase one from the airline.

The airline will have guidelines on the crate types allowed and your local pet supply company will be able to sell you the required crate. You pet should be able to stand and turn around with ease and there should be adequate ventilation. The bottom of the crate should be padded with newspaper or other absorbent material. Add a favorite toy on move day to give a sense of security. Try to get your pet accustomed to the crate at home before the big day.

On move day, feed and water your pet at least 5 hrs before the flight departure time and water again at least 2 hours before departure. Remember to administer any medication or veterinarian-recommended tranquilizers before departure. When you arrive at the airport, exercise your pet and check that you have provided all the necessary information to airline staff regarding your name, correct new address and alternate contact name in case of emergency.

Some airlines allow passengers to bring pets into the cabin with them, provided they fall within a specific size range and stay in a carrier for the duration of the flight.

By road – In a motor vehicle

Unless you are planning a very short road trip, do not feed or water your pet for a couple of hours before leaving. You may decide to put your pet in a crate during the road trip, but be sure he is able to stand and turn around with ease and that there is adequate ventilation. The bottom of the crate should be padded with newspaper, towels or other absorbent and cushioning material. Adding a favorite toy will help give a sense of security. Exercise your pet regularly during the road trip, but always use a leash because your furry friend can easily get lost or hit by a car if he wanders off.

Do not let your pet hang his head out the window while the car is moving. While many dogs love to do this, it can cause sore eyes, ears or throat. And, never let the windows down so far that your pet can jump out.

Warning

Never leave a pet in a hot car during the summer or in a cold car in the winter. Temperatures inside a car with closed windows escalate dramatically when it’s parked in the sun. Even if it’s pleasant outside, it takes only a few moments to reach over 100 degrees inside the car – which can be fatal for small occupants. If you absolutely have to leave your pet briefly, and the day is hot, park in the shade, lock the car doors and crack the windows open several inches to provide cross-ventilation. Check on him regularly. If the day is very hot, it is best not to leave your pet in the car at all.

Pet’s travel bag

Don’t forget to pack a travel bag for your pet! Following is a list of items you may wish to include;

• Food and can opener

• Food and water dishes

• Any medication your pets needs

• Treats

• Favorite toys

• Leash

• Grooming brush

• Bags to clean up after your pet

• Newspapers

• Cleaner and paper towel

Whatever mode of transport you use for your pet, make sure you are in compliance with state and local regulations for animals in your destination city, along with current copies of.

• ID tags

• Health records

Pets ID tags

The state where you are moving may have different laws regarding animals and their entry across state lines. It is important that you understand the requirements so that you can comply with them, so contact the state veterinarian for specific information. It is not uncommon for pets to need an entry permit in order to enter a new state. As well, in many towns and cities the number of pets per household may be limited. You will be required to obtain a local license for your pet within a certain deadline, such as 30 days, so find out what it is. You don’t want to pay a fine for not keeping your pet’s license current!

Health

You may need to obtain a health certificate for your pet from a licensed veterinarian and this can be used in the event it is required for entry to your new home state. The Department of Agriculture may request to see the health cert at your destination airport or could even be patrolling the highways if you are driving. A health cert is generally valid for 10 days, so be sure to have the inspection scheduled just before you move. The veterinarian will conduct a complete physical examination of your pet and check that he is current with all inoculations.

Dogs

Whether traveling by air or by car, moving can be even more stressful for a dog than for a human, although some dogs adapt better than others. Hold off on packing your dog’s bedding and toys until the last moment so that he can be comforted by the presence of familiar things. If you’re traveling a long way, avoid feeding your dog for 12 hours before the journey in order to prevent travel sickness. If you know your dog suffers from travel sickness, ask your veterinary surgeon about medication.

If you plan on flying to your new home, do your best to book a direct flight. If your dog has to be transported by freight and the flight is not direct he may have to sit out in the hot or cold weather as the freight is boarded to the new flight. Check with the airlines for details. If your dog is small enough, he may be able to travel in the passenger cabin with you. He will need a special pet carrier, which you can purchase at your local pet store. Ask the airline what crate specifications they require.

If traveling by car, have your dog’s nails cut to avoid damage to the upholstery. Carry an adequate supply of plastic bags and use these to clean up after your pet at any rest stops you use. Never let your dog hang his head out the window of a car when it’ s moving. Even though most dogs love to do this, it can cause sore eyes, ears or throat.

Never leave your pet alone in a car, especially in hot weather. The temperature inside the car can quickly rise to an unbearable level, even on what feels like a pleasant afternoon.

Once you arrive at your destination, be sure to get your dog back in to his routine of eating and exercise. If you have moved to an apartment building and your pet dog was used to having a yard to play in, you’ll need to be extra considerate. Walk your dog more frequently, at least until he gets used to his new living situation. Be patient and make allowances for indoor “accidents.” Don't punish your pooch, as this may make the problem worse. Clean the mess to remove the soil and smell. Once your dog has settled in, the accidents should stop. Use positive reinforcement to teach him where he needs to go. Always praise him when he relieves himself in the correct place.

One way to help your dog settle in more quickly is to create a comfortable sleeping area for him. If your new home has a yard, check the fencing to make sure that it is secure, of sufficient height and 'hole-free' before letting your dog run loose. If your dog is able to escape, exercise him on a lead until you are able to make the necessary improvements.

Cats

It’s commonly accepted that cats get very attached to places and typically hate to move. Cats get particularly comfortable with routine, and don’t like their environment to change. This can make moving especially difficult for humans and their cats.

In the days leading up to your move, try to keep your pet’s routine as normal as possible. It is best to crate your cat during the moving process, and it may be helpful to ask a friend or family member to keep an eye him.

If you are traveling by air, you may need to purchase an airline-approved carrier for you cat. You airline should be able to provide you with all the details. If you are traveling by car you may also want to use a crate or carrier so your cat cannot roam about the car, or escape through an open window or door.

Once you are in your new location, be careful to keep your cat indoors until he becomes comfortable in his new surroundings. Do not allow your cat outdoors, because he may try to return to you old home … and that’s obviously dangerous for him, especially if you’ve moved far away. Supervised outings are advised until your pet gets used to your new home. You can use a long leash on your cat and connect it to a stake in the ground, allowing your pet to wander the length of the leash for the first few days. Let your cat explore all the rooms of the house and be sure to check that outside doors and windows are closed before you begin.

Birds and Small Pets

Of all pets, birds are probably the most sensitive to changes in temperature and environment. Your pet bird can be moved in the cage in which it lives. When you are moving with your pet bird, be sure to use a cover for the cage. This can keep the bird calm and protect it from drafts. Place the cage in a shallow box to collect any gravel, feathers or droppings that may spill during transit. Remove any containers of food and water before moving the cage to avoid spills en route. Do feed and water your bird at its regular times, as birds, like all small animals, can become dehydrated very quickly in warm weather.

Some states require a health cert for birds entering the state. The USDA may inspect this cert either at the airport or during routine roadway inspections. Have your pet bird inspected by your veterinarian prior to traveling. Some health certificates are valid for a brief period of time. Ten 10 days is a common window for a health certificate.

Horses

There are several ways to transport horses. Your horse can be transported by air freight, by towing a trailer or by hiring a specialized horse transporting company. The horse transport company can use either air or road to transport horses.

By Air

Many airlines accept horses as air freight. In general, they will only transport horses on direct flights. You will be required to have a stall constructed to the airline’s specifications, and you will need to ensure your horse has the necessary health checks completed prior to moving to your new home state. Remember that requirements vary by state, and airlines will request a health certificate. The USDA may also be at the destination airport conducting inspections and may request to see the health certificate.

By Road

Depending on the distance you need to travel, towing your horse in a trailer behind your car or truck may be an option. If you do not own a trailer, you may consider renting one, but you’ll want to be sure you’re experienced enough to safely load and trailer your horse. You can also pack tack and feed in the trailer.

If your trip requires overnight stays you will need to book stables en route for your horse. These stables will require a health certificates appropriate to horses only, and if they do not you probably don’t want to board your horse there. Your veterinarian should be aware of the applicable laws of the different states and will be able to provide you with the necessary health certificates. (Contact information regarding states entry requirements is at the end of this guide.)

If you are unable to find a stable or lodgings for your horse in close proximity to your hotel, inquire whether the hotel will allow you to keep the trailer in the parking lot overnight. In inclement weather this is not advisable. Feed and water your horse per the normal routine and clean out the stall when you have an overnight stop.

Reptiles

Most states have strict government regulations regarding the entry of reptiles. See the states regulatory contact list at the end of this guide to find out what you need to do before moving your reptile from state to state.

As a general rule, the carrier that a reptile is transported in needs to be kept moist. Place the reptile in a cloth bag and fasten the top of the bag, making sure to leave the reptile enough room to move about, then place the bag in the shipping container. Use foam peanuts for cushioning and place damp paper or cloth in the shipper to keep the environment moist. Make sure there are air holes in the shipper for ventilation. If you are traveling overnight with your reptile you may need to place him in the tub of your hotel room at night for a nice long soak. Check if the hotel allows pets first.

Do not ship reptiles in excessively hot or cold weather, as their shipping container may be left outside for periods of time, leading to stress and possibly death.

Snakes must be handled with extra care, especially if they are venomous. Most airlines require double crating for snakes, which means putting the snake in one crate and then placing this crate in another, larger crate. Adequate ventilation is a must. The airline may provide you with stickers to put on all sides of the crate and you will need to write the type of snake on this label. You should also write on the sticker whether the snake is venomous or not.

**Warning

Remember to keep the surroundings of all reptiles moist, but not wet. Placing a damp cloth inside the container is one of the best ways to keep your reptile’s environment appropriately moist during transit.

Fish

Fish are notoriously difficult to move safely from one location to another, but it can be done effectively and efficiently with some planning. It is advisable to sell or give away as many fish as you can before you move to help ease the burden. However if this is not an option, this guide will help you understand what you need to do.

Depending on the size of your aquarium, and the number and type of fish you have, it may be easier to separate them into a several smaller tanks. If the aquarium is 5 gallons or less it may be just as easy to move the entire aquarium. Place some cellophane over the top of the aquarium and remove all heaters and aerators. Place the container in a cooler box or Styrofoam container to regulate the temperature and keep it constant for up to 48 hours. Be sure to open the cellophane every four to five hours to change and refresh the air. This option may be the best for tropical fish, which don’t do well in smaller containers with overcrowding or sudden changes in water and temperature.

Never leave the container in the car overnight, as the temperature changes may be too drastic for the fish. If you plan to be traveling to your destination for a couple of days with your fish it is advisable to purchase a portable aerator to keep the water well oxygenated. Always pack your aquarium last in the moving truck so that you can unload it quickly at your destination.

If you separate your fish into smaller containers or fish bags, you should try to use the aquarium water in order to keep the environment as constant as possible. In the event you do not have enough water for all the smaller containers, add fresh or saltwater appropriate to the type of fish. It is advisable to allow each container of water to settle for a few hours after filling. If you have only a small number of fish and are moving a short driving distance, you can move the fish to their new location by using plastic bags half-filled with water and half-filled with air. As a general guideline, each fish should have at least 1-2 gallons of water. To maintain the temperature, place the bags in an insulated container or Styrofoam container.

Most fish can go without food for a couple of days without any problems, but it is important to add healing agents to the water, as the fish may become bruised en route. This is not uncommon and you can purchase healing agents at your local pet supply store.

When you arrive at your destination set up the aquarium as quickly as possible. You may need to treat the water to neutralize any chemicals; your local pet store can advise you of any treatments the local water may need.

Turn the aerator on for a while, and then add slowly and gently add the fish to the tank one at a time. Wait until the water settles, and feed them as usual.

New Community

PLEASE, PLEASE be responsible when you move and check beforehand with your new community to find out if pets are allowed. Some apartment and condominium complexes may not allow pets, and you certainly don’t want to find that out on moving day.

Some of the most common reasons that people leave their pets with shelters are “we are moving “and “my landlord doesn’t allow pets.” Remember, pets do not know why their owners are leaving them behind, so do your homework beforehand to save all that heartbreak. Consider your options carefully, as pets should be considered a lifetime commitment. If you are absolutely unable to take your pet with you, you owe it to this creature to find him a good home.

State and local regulations

You need to make sure that your pet has some sort of easily read ID attached to its body. For dogs and cats this can be a collar, while a tag around the leg is appropriate for birds. The ID tag should have your pet’s name, destination address, your name and telephone number. It is also a good idea to have an alternate’s name and number on the tags in the event that somebody finds your lost pet and is unable to get in touch with you. You should also have rabies tags for your pet; depending on the state where you live this will most likely be a requirement. For air travel, your pet may be required to wear special travel tags, which the airline will provide.

Boat Trailer question?

I just bought an 88 sea nymph the trailer is a shore lander with the adjustable winch "stand" it is a slide type trailer with a small oval "pad" that guides the keel the guy I got it from had it set so the boat rode on that pad while trailering and this caused 4 rivets to be worn completely down to nothing causing a leak. I replaced the rivets and the boat is now water tight question is was the original intent for the bow to ride ONLY on the bow roller where the winch ties in and keep the less robust keel portion off that pad while trailering???

So I like to set my snubber so it is just above the bow eye, but the cutwater comes in snug. The cable or the strap comes under the snubber, usually through a hole and attaches to the bow eye.

So it sounds like you need to move your winch stand closer and lift your snubber just a bit.

Kawaski Jet

Kawaski, Sea do, yamaha, or honda for a Jet Ski?

In terms of Speed and price and durabilty...I want a full size one not one of the single ones... two or three person ones..

I own a pwc rental business and I have had pretty much everything, so in my opinion I only recommend these in this order;
1. Yamaha Waverunner
2. Honda
3. Kawasaki Jetski
4. Seadoo
The Yami is the most bullet-proof so far, I currently have 8 of these and they have taken the beating of rentals the best.
Kawasaki is the next best with minimal issues
The Seadoo's seemed like they were always broke down or needing parts.

I don't have a lot of first-hand experience with Honda but I hear great things and plan on buying them when I rotate my fleet.

How many parts bleach?

I have a 40 gallon aquarium to clean out for my two gerbils.I need to know how many parts bleach I should use.
Would it be unsafe for me to clean it in my tub?

you could try a solution of 1/9 parts water
ensure you dry it in the sun for a few days until you can no longer smell bleach
However most gerbil sites strongly reccommend you use only disinfectant

This is a must. Like helmets when you ride a motorcycle, the Law requires anyone who uses jet ski to wear life jackets. It doesn't matter if you know how to swim or not. If you are going to drive or ride a jet ski, you must wear Life Jacket. Aside from life jacket, you should be in proper attire when riding jet ski. These are gloves, goggles, and a wet suit.

Never ride close to another watercraft...

Most jet ski accidents are caused by collisions, so in order to prevent this from happening, stay at least 100 feet away from another watercraft, divers, rafts, and swimmers. Most beaches and lakes have set of rules with regards to the use of Jet Skis so you should know them first.

Never use the jet ski at night...

You might wonder why this riding at night should be avoided. Well, here is the main reason: open sea is dangerous at night. Never attempt ride on pitch-black waters. You will never know if there are other watercrafts on your way and you will never know the behavior of the water at night. And another thing: in case you get in the middle of the ocean, you have to wait for the sun to rise before anyone can see you.

Never ride a jet ski without lanyard...

What is a lanyard? A lanyard automatically cuts the engine in case you fall from the jet ski. It will spare you from swimming back at the shore at the same time save you machine from stowing away alone.

Be conscious on the rights of others...

Never let your jet ski becomes annoying to others. In other words: be mindful that there are other people who don't want to be destructed by the sound or the wave your jet ski is making.

What is a good way to cure a bad case of jet lag?

Just got back from France for the weekend - no jet lag. The secret is figuring out time in the country you are going to and compare it to your normal schedule. France is 6 hours ahead for example, from the East Coast - so we stayed out until 4am (10pm EST time) and slept until 12n (6am EST) every day - no jet lag. Great time too.

Aviation Sights of Virginia

Although Virginia, as an aviation destination, may seem a shadow of Washington with its world-reknowned National Air and Space Museum of the Smithsonian Institution, half of that magnificent facility actually sits in Virginia itself, and the state’s numerous other, although smaller, sights offer significant aviation focuses, from barnstorming airfields to space capsules.

The National Air and Space Museum’s second facility, the Steven F. Udvar-Hazy Center, is located in Chantilly, Virginia, next to Washington-Dulles International Airport.  Constructed to preserve and display the remaining 80 percent of the aerospace collection too large and too numerous for either the existing structure on the National Mall or the Paul E. Garber Preservation and Restoration Facility in Suitland, Maryland, the modern, hangar-appearing building, named after International Lease and Finance Corporation Chairman and Chief Executive Officer Steven F. Udvar-Hazy in recognition of his $65 million donation, had broken ground on October 25, 2000 when Hazy himself had turned the first shovel.  The project, ultimately costing $311 million for design, site infrastructure, and building, and requiring a 600-strong construction team, had required some three years to complete before the first of several opening ceremonies could be held.

The first of these, amid the season’s first snowstorm, had taken place on December 3, 2003 and had entailed a special, pre-public “Appreciation Day” held for its sponsors, donors, and National Air and Space Society members.  The event, precluded by a military ceremony of the Star Spangled Banner and a tributary speech by Museum Director General Jack Dailey, had entailed a day-long series of programs and the unveiling of many of the aircraft exhibited.

The other museum inaugurations, including the “Salute to Military Aviation Veterans,” the “Opening Celebration Gala,” and the “Museum Dedication,” had preceded the actual public opening, held on December 15, 2003, the centennial celebration of the Wright Brothers’ first powered, sustained, and controlled heavier-than-air flight at Kitty Hawk, North Carolina.

Divided into two main areas, the Steven F. Udvar-Hazy Center features a collection of 141 aircraft, 148 large space artifacts, and more than 1,500 smaller items.  The first area, the Boeing Aviation Hangar, measures 986 feet long, 248 feet wide, and 103 feet high, and displays aircraft on three levels, while the second, the James S. McDonnell Hangar, is comparatively 262 feet long, 180 feet wide, and 80 feet high.  The 164-foot-high Donald D. Engen Observation Tower overlooks Dulles International Airport and the 479-seat IMAX Theater completes the experience.

Exhibits are grouped in 16 broad categories: Vertical Flight, Sport Aviation, Business Aviation, Commercial Aviation, Pre-1920 Aviation, Korea and Vietnam, Cold War Aviation, Modern Military Aviation, Aerobatics, German World War II Aviation, Ultralights, Military Aviation: 1920-1940, Human Spaceflight, Space Science, Applications Satellites, and Rockets and Missiles.

Early aviation is represented by aircraft such as the Langley Aerodrome A, the Nieuport 28C-1, and the SPAD XVI, while World War II designs include the North American P-51C Mustang and the Boeing B-29 Superfortress “Enola Gay,” which had dropped the atomic bomb over Hiroshima, effectively ending the war.  Naval aviation is represented by aircraft such as the Vought F4U-1D Corsair and the Grumman F6F-3 Hellcat.  Among the pure-jet fighters are the Lockheed T-33A Shooting Star, the McDonnell F-4S Phantom II, the Grumman F-14 Tomcat, and the Grumman A-6B Intruder. 

The museum’s transport category aircraft represent piston, pure-jet, subsonic, and supersonic designs, some of which are very rare, such as the German Focke-Wulfe Fw 190F, a quad-engined, tail-wheel aircraft which had application as an airliner; the German Junkers Ju 52/3m, with its three engines, corrugated metal airframe, and tail wheel; the Boeing B-307 Stratoliner “Flying Cloud,” the world’s first four-engined, pressurized passenger transport; the Lockheed L-1049H Constellation; the Boeing 367-80, the prototype of the Boeing 707; and the supersonic Concorde.

Supersonic military aviation is represented by the Lockheed SR-71A Blackbird.

The James S. McDonnell Hangar, whose centerpiece is the Space Shuttle Enterprise, features a rich collection of spacecraft, rockets, and satellites, among them the Gemini VII capsule, the Mariner 10, the Mercury Capsule 15B, a Redstone rocket, and the Mobile Quarantine Unit used after return of the Apollo 11 mission.

The Steven F. Udvar-Hazy Center, together with the original National Air and Space Museum building on the National Mall, forms an integral part of the world’s largest aerospace museum.

The 200-acre Flying Circus Aerodrome, for instance, located in Bealeton, Virginia, and created in 1971, offers 1920s- and 1930s-era biplane air shows every Sunday from May to October reminiscent of the barnstorming days of aviation, billing itself as “the greatest show off earth.”  Its fleet, which is mostly hangared at the nearby Warrenton Airport and flown in on weekends, includes enclosed Piper Cubs and open-cockpit N2S-1 and –3 Stearman, Waco, and Fleet biplanes, and is available for both straight-and-level and acrobatic rides of between 15 and 30 minutes before and after the shows.

After paying at the entrance booth, cars park on the grass behind the public area, which includes bench-type seats, Fifi’s Air Show Café for light fare, and a tiny, gray barn gift shop.  A few hangars, located across the field and bearing red-and-white checkered roofs with names such as “Curtiss,” can also be visited.

The annual Air Show Program features many special event days, including antique cars, tractors, motorcycles, model airplanes, and hot air balloons.

Entrance immediately transports the visitor through a time portal to the barnstorming era.

A summer flight, aboard a Waco biplane, further returned me to this era.  Unleashing itself over the grass with a full, 1,900-rpm throttle application, the aircraft, propelled by its single, uncowled engine, lifted its tail wheel off of the now blurred carpet of green and surrendered its two, fabric-covered wings into the sky at 70 mph.

Banking right to a 030-degree heading at 300 feet, it had settled into a 200 foot-per-minute climb in the hot, flawlessly-blue August sky over central Virginia’s rolling green canvas.  Settling into its 600-foot aerial plateau, it cruised over light-green, velvet-appearing fields, bordered by dark green trees, which resembled modern geometric art patterns.  Silver hay silos had triumphantly risen from them.

Commencing a series of figure-eights over rectangles of dry, almost-golden fields, whose plow marks appeared like textural brushstrokes, the biplane assumed a westerly heading toward the soft green ridges of Shenandoah National Park ahead of the blurred propeller, before initiating a much-too-soon, power-reduced sideslip over the ever-enlarging trees toward the field and gently settling on to the grass with its two main wheels.

The Virginia Aviation Museum, located closer to the eastern seaboard at Richmond International Airport, entices visitors with its outdoor Lockheed SR-71 Blackbird and features 36 indoor historic, vintage, and reproduction aircraft, including the Wright Brothers’ kites, gliders, and 1903 Flyer; the Vultee V1-AD once owned by William Randolph Hearst; the Fairchild FC-2W2 Admiral Richard E. Byrd had used to overfly Antarctica; and a collection of piston and pure-jet engines.  A full-size Piper J-3 Cub, which had recently been relocated from Science Museum of Virginia affiliate, permits examination of the four forces of flight, while several simulators and interactive exhibits explore aerodynamics.

Early aviation, the collection’s principle focus, includes several pristine-condition mono- and biplanes, such as a 1918 Standard E-1 Advanced Trainer, a 1917 SPAD VII fighter, the only known existing Wright Model A-14D Speedwig, a purpose-designed mail-carrying Pitcairn PA-5 Mailwing from 1927, a 1927 Travel Air 2000, a 1930 Fleet Model 1 military basic trainer, and a 1918 Curtiss JN-4D Jenny.

Both piston and pure-jet engines include a Wright J-6 Whirlwind 5, a Curtiss OX-5, a 1914 Le Rhone 9C rotary engine, a Wright R-2600 Cyclone 14, a Pratt and Whitney R-4360 Wasp Major, a Continental A-65, a General Electric J-31, and a Pratt and Whitney J-58.

Dioramas depict World War II, the Tuskegee Airmen, and Women’s Airforce Service Pilots.  Educational programs, catering to student, scout, and senior citizen groups, include lessons such as “The Wright Math,” “The Wright Path,” “Paper Airplane Workshop,” “Balloons and the Civil War in Virginia,” and “Seniors Discover the World of Aviation.”

Further south, in Hampton Roads, its outdoor Air Power Park, dedicated in recognition of the contributions made by NASA and Langley Air Force Base to aerial and space development and for their interest in community endeavors, include several unique aircraft designs, inclusive of the Lockheed T-33A T-Bird, an A-7E Corsair II, an XV-6A Kestrel V/STOL, a North American F-86L Sabre, the later-developed North American Rockwell F-100D Super Sabre, a McDonnell F-101F Voodoo, a Northrop F-89J Scorpion, and a Republic Aviation F-105D Thunderchief.  Even rarer, perhaps, is its space-related collection, including an SM-78 Jupiter surface-to-surface intermediate-range ballistic missile, a Western Electric NIM-14 Nike-Hercules two-stage missile, a Jet Propulsion Lab M-2 Corporal Ballistic Missile, a North American Aviation Mercury/Little Joe Booster, and a Mercury Test Capsule.

The Virginia Air and Space Center, located in downtown Hampton on the waterfront, is a $30 million, 110,000 square foot, nine-story facility which had opened on April 5, 1992 and is characterized by its futuristic, interconnected, dual-building, gull wing roof-resembling architecture.  Its more than 30 historic air- and spacecraft, which represent more than 100 years of flight, are exhibited in the recently completed, $9 million Adventures in Flight Gallery and the Space Gallery, and include such designs as the Apollo 12 Command Module which had made the journey to the Moon, an AirTran DC-9-30, a B-24 Liberator nose section, an F.84 Thunderstreak, an F-4E Phantom II, an N2S-3 Stearman, a Lunar Orbiter, an F-104 Starfighter, an F-106 Delta Dart, a YF-16 Fighting Falcon, and a P-39Q Aircobra.  A new exhibit, “Space Quest: Exploring the Moon, Mars, and Beyond,” had recently been introduced in the Space Gallery.  Extensive, hands-on exhibits, featuring hot air balloons, noise abatement, a Boeing 717 glass cockpit fight simulator, aircraft flight surfaces, propeller efficiency comparatives, and Space Shuttle landing simulators, are complemented by the Riverside IMAX and Curtiss Jenny Century of Flight Theaters.

The Virginia Air and Space Center depicts a timeline of Virginia aviation achievements.  The first-ever captive balloon ascent from a ship, for example, a Union Army vessel anchored at Hampton Roads, had occurred in 1861, and Eugene Ely had become the first to take off from what had been considered the first aircraft carrier, the USS Birmingham, anchored nearby, in 1910.  The Langley Aeronautical Laboratory, the predecessor of NASA Langley, had been established.  In 1927, the USS Langley, a converted collier, had been commissioned as the US Navy’s first aircraft carrier.  In 1931, NACA Langley had opened the world’s first full-scale wind tunnel capable of testing full-size aircraft at speeds of up to 118 mph.  In 1934, the Newport News Shipyard had constructed the first purpose-built aircraft carrier, the USS Ranger.  The National Advisory Committee for Aeronautics (NACA) had become the National Air and Space Association (NASA) in 1958 and America’s first astronauts, the Mercury Seven, had trained at the NASA Langley Research Center.  The United States’ first transonic wind tunnel had opened at NASA Langley in 1982.

The museum also serves as both the Visitor Center for the NASA Langley Research Center and Langley Air Force Base.  Four miles north of the museum, the US Army had purchased land in December of 1916 in order to construct, in cooperation with the National Advisory Committee for Aeronautics, an airfield.  The Army had subsequently trained crews and tested aircraft there during World War I.  In 1921, Brigadier General William “Billy” Mitchell had led bombing trials from Langley to demonstrate the feasibility of air patrol and its effectiveness in destroying battleships.  Major General Frank Andrews later led a combat air command, which became the forerunner of the Army Air Forces of WWII and ultimately evolved into today’s US Air Force.

Virginia, although initially perceived as a shadow of Washington with its Smithsonian Institution on the National Mall, is a relatively small state which offers a long, multi-faceted aviation journey.

Turbo kits for a 02 stratus?

Question is simple I have a 2002 Dodge Stratus 2.4L DOHC Vin (X) I need to find out a little more about the engine if any one can give me any i think its time for an engine rebuild it has 140k on it so its gonna need major service soon and while I am in imma put a turbo in it I've been told many many times that that same engine was used in the eclipse If so what gen and that way i can go ahead and work off of that

The DOHC cam motor shares NOTHING with the Mitsu SOHC 2.4 motor.

If you desire a turbo motor. Look at the SRT4 and PT crusier.

If you insist in building a turbo motor. Then use the turbo 2.4 parts. Those parts are stronger then the N/A parts. The turbo oiling system is better because it increases oil flow.
